Registration, renewal and record-keeping fall on the facility owner, and the rules apply to far more than gas stations. Per New York State open data, November 2026, apartment and office buildings are the largest group of registered facilities with a named site type, ahead of retail gas stations, schools and municipal sites.
The common exception: a heating-oil tank used on-site, holding less than 1,100 gallons and not connected to another heating-oil tank, is generally not covered, unless the property has other regulated tanks. Ask us if you're unsure.
Registration renews every five years. DEC's fee depends on the total capacity at the facility:
| Total capacity | Fee per facility |
|---|---|
| More than 110 to 1,100 gallons | $0 |
| More than 1,100 to 2,000 gallons | $100 |
| More than 2,000 to less than 5,000 gallons | $300 |
| 5,000 to less than 400,000 gallons | $500 |
Nassau, Suffolk, Westchester and Cortland counties run their own programs, and they may have stricter requirements.
