Who Needs to Comply?
- All buildings with parapets fronting the public right-of-way, regardless of height.
- Buildings with visible cracks, loose masonry, or previous violations.
What Are the Legal Requirements?
Under Local Law 126 of 2021, amendments to the NYC Building Code Sections 28-302.1 and RCNY §103-04 now require parapet inspections as part of facade assessments.
Who Can Perform Parapet Inspections?
- A competent person (e.g., building manager, superintendent, or engineer) may conduct annual parapet observations.
- If structural concerns arise, a Qualified Exterior Wall Inspector (QEWI) — a licensed architect or professional engineer — may be required for detailed evaluation.

Deadline to Inspect
All required parapet inspections must be completed by December 31 of each year.
Fines & Penalties for Non-Compliance
- Failure to Maintain Parapet in Safe Condition: Additional DOB penalties may apply under 1 RCNY §102-01.
- Failure to Conduct Inspection & Maintain Records: Owners must keep inspection records for at least six years. The penalty for failing to provide the annual parapet observation report upon request is a minimum of $1,250, up to $10,000.
